The Directives (EU) 2019/770 and 771 required a comprehensive reform of Austrian warranty law through the "Gewährleistungsrichtlinien-Umsetzungsgesetz" (GRUG), which is now primarily reflected in the "Verbrauchergewährleistungsgesetz" (VGG), but also in the warranty law section of the ABGB and the KSchG. The Austrian legislator did not follow the example of other EU countries, where direct warranty claims are permitted against the producer. Shortly after the one-year anniversary of the GRUG, the lecture will therefore take stock of the reformed warranty law and discuss whether such direct liability is still - or even more - appropriate. Among other things, the lecture will also deal with the prerequisites of liability as well as questions ofn the statute of limitations. Recent developments regarding the new proposal for a Directive on common rules promoting the repair of goods will also be discussed in this lecture.
