Das Wahlfach “Einführung in das spanische Recht und die spanische Rechtssprache” ist darauf ausgerichtet, einen Überblick über das spanische Rechtssystem und seine wichtigste Konzepte und Institutionen sowie den Studierenden eine Einführung in die spanischen Rechtssprache und ihrer spezifischen Terminologie zu bieten. Ziel des Faches ist es gegebenenfalls, dass die Studierenden die wichtigsten Begriffe und Ausdrücke der spanischen Rechtssprache erlernen mit dem Ziel verschiedene juristische Texte wie z.B. Gesetze, Urteile oder Aufsätze lesen und verstehen zu können.
Das Fach ist für Studierende geeignet, welche beabsichtigen, im Rahmen des Erasmus-Programms einige Studiensemester ihres Jus-Studiums in Spanien Jus zu absolvieren oder welche ein Praktikum in Spanien machen möchten oder sich im Rahmen ihrer Forschungen im Bereich des spanischen Rechtes spezialisieren möchten oder für Studierende der Romanistik die sich für Rechtssysteme interesieren.
Dazu werden verschiedene Aspekten des spanischen Rechtes berücksichtigt: die Rechtsquellen; die wichtigsten Institutionen des Öffentlichen Rechtes: die spanische Verfassung von 1978 (Geschichtliche Entwicklung, Struktur, die Gewaltenteilung in der Verfassung, Staatstruktur und die Gebietskörperschaften, Estado, Comunidades Autónomas und Entes locales), Verwaltung und die Verwaltungsakte; Einführung in die Organisation des spanischen Rechtsprechung und in das spanischen Prozessrecht; Ansatz auf andere Rechtsgebiete.
Die Lehrveranstaltung wird auf Spanish (und Teilweise auch auf Deutsch) abgehalten, Spanisch-Grundkenntnisse sind wünschenswert. Es werden sowohl theoretische als auch praktische Inhalte erarbeitet: Lösung von Fällen, Übungen in schriftlicher und mündlicher Rechtssprache, insbesondere durch das Lesen und Übersetzen verschiedener juristischer Texte.
Die Evaluierung wird in Form einer schriftlichen Prüfung am Ende des Kurses mit theoretischen und praktischen Fragen aus dem Inhalt des Programms durchgeführt. Eine regelmässige Anwesenheit und aktive Mitarbeit bei den Übungen in der Lehrveranstaltung wird massgeblich berücksichtigt.

Expected results, method and contents
The course “Introduction to the Spanish Law” expects to provide an overview about the Spanish legal system and its most important concepts and specific terminology. It aims, at the same time, that the students learn the most important terms and expressions of the Spanish legal language, with the goal of providing tools for reading legal texts, like laws, sentences or essays.
The subject is suitable for students who intend to complete their studies in Spain as part of the Erasmus program, those that wish to specialize in the field of Spanish law, or for students of Romance studies.
Various aspects of Spanish law are taken into account: the sources of law, the most important institutions of public law: the Spanish Constitution of 1978 (historical development, structure, division of powers, state’s structure and territorial authorities: Estado, Comunidades Autónomas and Entes Locales), administration and administrative acts; introduction to the organization of Spanish judicature and to the Spanish procedural law and approach to other law branches.
The course is held in Spanish (and partly in German). Spanish basic knowledge is desirable. Both theoretical and practical contents will be developed by solving practical cases and written and oral exercises, in particular by reading and translating different legal texts.
The evaluation is carried out in the form of a written examination at the end of the course with theoretical and practical questions. A regular assistance and active participation in the exercises during the course is taken into account.
